TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Vibe Card app ("the App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. You must be at least 13 years old to use the App. If you do not agree, do not use the App.

2. DESCRIPTION OF SERVICE

Vibe Card is an AI-powered application that generates Pokémon-style personality cards from pet photos. You upload a photo plus three vibe descriptors; we send those to an AI model (Anthropic\u2019s Claude) which returns an archetype, motto, fatal flaw, stat distribution, element type, and rarity. The result is rendered as a holographic card on your device.

AI-generated content disclosure. Card text and stats are generated by an AI model. Output varies per generation, may not be factually accurate, and is intended for entertainment only. We do not warrant the accuracy, breed identification, or character description of any generated card.

3. ACCOUNTS

You may use Vibe Card as a guest (anonymous account) or sign in with Apple. You are responsible for maintaining the security of your account credentials. Guest accounts are tied to a single device and may be lost if the app is uninstalled.

You may delete your account at any time via Settings → Account → Delete Account. Deletion is permanent — your cards, history, and account data cannot be recovered.

4. SUBSCRIPTIONS AND PAYMENTS

Vibe Card offers a free tier (limited daily card generations) and a paid Vibe Card Pro subscription. Subscriptions are managed through Apple\u2019s App Store:

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID at confirmation of purchase.
• You can manage or cancel subscriptions in iOS Settings → [Your Name] → Subscriptions.
• Refunds are handled by Apple per their published refund policy.

5. YOUR CONTENT

You retain full ownership of the photos you upload. You grant us a limited, non-exclusive license to process those photos for the sole purpose of generating your card and operating the App (including transient transmission to AI providers and image-classification providers as listed in our Privacy Policy).

You retain ownership of your generated cards. By tapping "Share" on a card, you grant us permission to expose that specific card at a public permalink (vibe-card.app/share/<id>) and to display it as an opponent in other users\u2019 battle screens. You can disable sharing or delete a card at any time.

6. USER-GENERATED CONTENT AND ACCEPTABLE USE

Vibe Card includes social features (public share permalinks, battle mode). Pet names, vibe descriptors, and uploaded photos are user-generated content visible to other users in some contexts.

There is zero tolerance for objectionable content or abusive behaviour. You agree not to submit:

• Photos of humans (especially minors), nudity, sexual content, or violent / gory imagery.
• Photos that aren\u2019t of your own pet or a pet you have permission to photograph.
• Pet names or vibe descriptors that contain hate speech, slurs, threats, harassment, or sexual content.
• Any content that infringes third-party intellectual property or privacy rights.

We use automated pre-classification (Sightengine) and AI moderation to filter unsafe inputs and outputs, plus a manual review queue for user reports. Users can report any card that appears in their share or battle context — we review reports within 24 hours and remove violating content. Repeat or severe violators are blocked from the service.

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App or our API.
• Attempt to gain unauthorized access to our servers, other users\u2019 accounts, or any part of the service.
• Probe, scan, or test the vulnerability of the service except via responsible disclosure to support@vibe-card.app.
• Interfere with or disrupt the App\u2019s infrastructure, including by automated request flooding.
• Resell, sublicense, or commercially exploit the App without written permission.

7. REPORTING AND BLOCKING

You can report any card or interaction that violates these Terms via the Report button in the app, or by emailing support@vibe-card.app. We aim to respond to reports within 24 hours during business days. We may remove content, suspend accounts, or block users without prior notice for violations of these Terms.

8. DISCLAIMER OF WARRANTIES

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

AI output disclaimer. Cards generated by the App are creative interpretations produced by an AI model. They are not factual statements about your pet, breed identifications, behavioural diagnoses, or veterinary advice. Do not rely on a Vibe Card for any decision affecting your pet\u2019s welfare, training, or health.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Anton Usov shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App.

10. ACCOUNT TERMINATION

You may delete your account at any time via Settings → Account → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. On termination, your right to use the App ends immediately.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will require re-acceptance on next app launch. Continued use of the App after changes constitutes acceptance.

12. GOVERNING LAW

These Terms are governed by the laws of Austria. Any disputes shall be resolved in the competent courts of Austria, except where mandatory consumer-protection law provides otherwise for users resident in another jurisdiction.
